Article 1: general provisions

The e-commerce website of LS Fashion Kids, with registered office at Lippenslaan 267 box 2.1, 8300 Knokke-Heist, VAT BE0871.370.202, offers its clients the opportunity to purchase the products from its online store online.

These Terms and Conditions ("Terms and Conditions") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order through LS Fashion Kids' online store, the Customer must expressly accept these Terms, thereby agreeing to the applicability of these Terms to the exclusion of all other terms and conditions. Additional conditions of the customer are excluded, except when previously, in writing and expressly accepted by LS Fashion Kids.

 

Article 2: Price

All prices stated are in EURO, always including VAT and all other taxes or duties to be borne by the customer.

If delivery, reservation or administrative costs are charged, this will be stated separately.

The indication of price refers exclusively to the articles as described verbatim. The accompanying photographs are for decorative purposes and may contain elements not included in the price.

 

Article 3: offer

Despite the fact that the online catalog and the e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind LS Fashion Kids. LS Fashion Kids is as far as the accuracy and completeness of the information offered is concerned only held to a means commitment. LS Fashion Kids will under no circumstances be liable in the event of manifest material errors, typesetting or printing errors.

If the Customer has specific questions about e.g. sizes, color, availability, delivery time or method of delivery, we ask the Customer to contact our customer service department in advance via email [email protected] or by phone 050 51 15 08.

The offer is always valid while supplies last and may be modified or withdrawn by LS Fashion Kids at any time. LS Fashion Kids cannot be held liable for the unavailability of a product. If an offer has a limited validity or is made subject to conditions, this will be explicitly stated in the offer.

 

Article 4: Online purchases

If you wish to buy the product, you can place it in your shopping cart. At the top right of the webshop you always see your shopping cart and an overview of the items you have added. From the shopping cart you can choose checkout. If you are a new customer, you can enter all your data and choose a password. This is not mandatory, but we definitely recommend it. That way you don't have to enter everything again the next time you make a purchase. We undertake not to share this information with third parties. If you are already a customer, simply enter your login and password.

Ordering by phone

Ordering via the website is always the easiest. We assure you a safe and reliable internet environment and payment platform. However, if you do not feel comfortable with this environment, you can also place an order by phone

Confirmation email

After your order you will receive a confirmation email. Should there be an error in our stock system, you will receive a message about this the next working day at the latest. The information regarding the products and pricing, as well as the detailed order information are prepared and communicated subject to change and correction.

The Customer has the choice between the following payment methods:

LS Fashion Kids is entitled to refuse an order due to a serious shortcoming of the Customer regarding orders involving the Customer.

 

Article 5: Delivery and execution of the agreement

Deadline

LS Fashion Kids always aims to get your package ready for shipment within 1 to 2 working days after receipt of payment. Depending on the way the package is sent, it can take up to a maximum of 3 to 4 working days for the package to be delivered to your home.

Shipping costs

No shipping costs are charged for personal delivery or pick-up in store.

Attention: This is only possible during opening hours.

To Belgium: 

Free shipping for Belgium from 100€. If your order is lower than 100€, you always pay a flat rate of 5€ for shipping to Belgium. The parcel is delivered to your home with BPost. If you are not present at the time of delivery, you will receive a written notification in the mail and you can pick up the package at the post office. Of course, if you wish, you can always enter your work address or the address of a neighbor or friend during the order under "delivery address".

To the Netherlands, France and Germany: 

Free shipping from 115€. If your order is less than 115€, you pay a fixed shipping fee of 7€ for the Netherlands and France and 7€ for Germany. 

 

Items ordered through this web store are delivered in Belgium, the Netherlands, France and Germany.

 

Delivery is made by Bpost or by personal collection in the store.

 

Unless otherwise agreed or expressly stipulated, the goods are delivered to the customer's residence within 30 days of receipt of the order.

 

Any visible damage and/or qualitative deficiency of an item or other shortcoming in delivery must be reported by the Customer to LS Fashion Kids without delay.

 

The risk due to loss or damage passes to the side from the moment he (or a third party designated by him, who is not the carrier) took physical possession of the goods. However, the risk already passes to the customer upon delivery to the carrier, if the carrier was instructed by the customer to transport the goods and this choice was not offered by LS Fashion Kids.

 

Article 6: retention of title

The delivered items remain the exclusive property of LS Fashion Kids until the moment of full payment by the customer.

 

The customer undertakes, if necessary, to inform third parties of LS Fashion Kids' retention of title, e.g. to anyone who might come to seize items that have not yet been paid for in full.

 

Article 7: Right of withdrawal

The provisions of this article apply only to Customers who purchase items online from LS Fashion Kids in their capacity as consumers.

 

If the right of withdrawal applies:

 

The customer has the right to revoke the contract within a period of 14 calendar days without giving any reasons.

 

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, other than the carrier, takes physical possession of the good.

 

To exercise the right of withdrawal, the Customer must inform LS Fashion Kids, Lippenslaan 180, 8300 Knokke-Heist, [email protected], 050 51 15 08 of his decision to withdraw from the contract by an unequivocal statement (e.g. in writing by post, fax or e-mail). The customer may use the attached model withdrawal form for this purpose, but is not obliged to do so.

 

To comply with the withdrawal period, the customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.

 

The customer must return or hand over the goods to LS Fashion Kids, Lippenslaan 180, 8300 Knokke-Heist, without delay, but in any event no later than 14 calendar days from the day on which he communicates his decision to withdraw from the contract to LS Fashion Kids. The customer is on time if he returns the goods before the period of 14 calendar days has expired.

 

The direct costs of returning the goods shall be borne by the customer.

 

If the returned product is somehow reduced in value, LS Fashion kids reserves the right to hold the customer liable and claim compensation for any reduction in the value of the goods resulting from the customer's use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.

 

Only items in their original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.

 

If the customer revokes the agreement, LS Fashion Kids will refund all payments received from the customer up to that point, excluding standard delivery costs, to the customer within a maximum of 14 calendar days after LS Fashion Kids is informed of the customer's decision to revoke the agreement. In the case of sales contracts, LS Fashion Kids may wait to be reimbursed until it has received back all the goods, or until the customer has proved that he has returned the goods, whichever comes first.

 

Any additional costs resulting from the customer's choice of a mode of delivery other than the least expensive standard delivery offered by LS Fashion will not be refunded.

 

LS Fashion Kids will refund the customer using the same means of payment with which the customer made the original transaction, unless the customer has expressly agreed otherwise; in any case, the customer will not be charged for such refunds.

 

Article 8: Guarantee

Pursuant to the Act of September 21, 2004 on consumer protection in the sale of consumer goods, consumers have legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights.

 

Keep original packaging of the goods.

 

For items purchased online and delivered to the Customer's home, the Customer must contact LS Fashion Kids customer service and return the item to LS Fashion Kids at their expense.

 

If a defect is detected, the Customer must inform LS Fashion Kids as soon as possible. In any case, any defect must be reported by the Customer within a period of 2 months of its discovery. Thereafter, any right to repair or replacement will lapse.

 

The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the user instructions or manual, adjustments or modifications to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

 

Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, subject to proof to the contrary by the Customer.

Article 10: Sanctions for non-payment

Without prejudice to the exercise of other rights available to LS Fashion Kids, in the event of non-payment or late payment, the Customer shall be liable, ipso jure and without notice, to pay interest of 10% per year on the amount not paid. In addition, the Customer shall be liable, ipso jure and without formal notice, to pay a fixed indemnity of 10% on the amount involved, with a minimum of 25 euros per invoice.

 

Without prejudice to the foregoing, LS Fashion Kids reserves the right to take back items that have not been paid for (in full).

 

Article 11: Privacy

The controller, LS Fashion Kids respects the Belgian law of December 8, 1992 relating to the protection of privacy in the processing of personal data.

 

The personal data you provide will only be used for the following purposes: the execution of the contract, processing the order, sending newsletters, advertising and / or marketing purposes.

 

You have a legal right to access and correct your personal data. Provided proof of identity (copy identity card), you can obtain the written communication of your personal data free of charge via a written, dated and signed request to LS Fashion Kids, Lippenslaan 180, 8300 Knokke-Heist, [email protected]. If necessary, you can also ask to correct the data that would be incorrect, incomplete or irrelevant.

Customers are solely responsible for keeping their login information confidential and using their password. Your password is stored encrypted, so LS Fashion Kids has no access to your password.

Article 12: Use of cookies

Article 13: Invalidity - non-enforcement

If any provision of these Terms is declared invalid, illegal or null and void, this shall in no way affect the validity, legality and applicability of the other provisions. 

 

The failure at any time by LS Fashion Kids to enforce any of the rights enumerated in these Terms, or to exercise any right thereof, shall never be deemed a waiver of such provision and shall never affect the validity of these rights.

 

Article 14: modification of conditions

These Conditions are supplemented by other conditions explicitly referred to, and the general terms and conditions of sale of LS Fashion Kids. In case of contradiction, these Conditions shall prevail.

 

Article 15: proof

The customer accepts that electronic communications and backups may serve as evidence.

Article 16: Applicable law - disputes

Belgian law is applicable, with the exception of the provisions of international private law on applicable law.

 

The courts of the place of residence of the Consumer are competent in case of legal disputes. The Consumer can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
